1. Introducction This Privacy Policy regulates the access, use and management of the personal data inside the application (from now on the “Application”), that gathers, utilizes, shares and protects the personal data processed through the application IC Workers Tracker. The objective is to provide information related to temporary employment contracts from foreign workers outside the U.S.A. to authorized clients, including visa management and the status of active contracts.

The use of the Application implies the complete and unreserved acceptance of this Privacy Policy.2. Data Management Accountability

The data manager is the owner of the Application (from now on, the “Owner”) who determines the purpose and management means of the information collected.

3. Collected Information

The Application can collect and process the following data:

·      Personal identification data (name, position, etc)

·      Immigration information (type of visa, status, etc)

·      Employment information (contracts, workers, duration, working conditions)

·      Contact Information.

·      Access registry and Application usage.

·      Worker’s names and working details.

·      Contract Information.

·      USCIS numbers, CNPC numbers

·      Cases statuses, appointments and other identifiers.

·      Device type and operating system.

·      IP Address.

·      Registries, metrics and diagnostic data.

The Application does not gather payment data nor allows the upload of multimedia files

All collected data are considered confidential.

4. Management Purpose

The personal data will be used exclusively to:

·      Manage and administrate temporary employment contracts.

·      Provide updated information to authorized clients.

·      Provide follow-ups on immigration and working processes.

·      Guarantee the compliance of contract obligations.

The Owner uses personal data to operate the Application, authenticate users, display worker information, provide technical support, enhance security, and comply with legal obligations.

Under no circumstances will the data be used for purposes other than those set forth herein.

5. Restricted Access and User control

Access to the App is strictly limited to:

·      Clients authorized by the Owner.

·      Previously approved and verified users.

Access to or use of the App is expressly prohibited by:

·      Not authorized people or companies.

·      Users not expressly approved by the Owner.

·      Minors.

The Owner reserves the right to approve, deny or revoke the access at any given moment, without the need for previous justification.

6. Confidentiality and Data usage

The authorized users agree to:

·      Not divulging, sharing or transferring the data to third parties

·      Not using the data for commercial or competitive means

·      Not reproducing, coping or saving the data outside of authorized means

The misuse of the data can result on the immediate access cancelation and corresponding legal action.

7. Data Security

The Owner implements technical, administrative and organizational means adequate to:

·      Protecting the data against non-authorized access

·      Preventing loss, alteration or unauthorized disclosure

·      Guarantee the integrity and confidentiality of the data

However, no system is completely secure, for which we cannot guarantee absolute security.

8. Data Storage

The data will only be stored during the necessary time needed to comply with the described purposes or in accordance with applicable legal obligations.

9. Data Subject Rights

The data subjects can request:

·      Access to their personal information

·      Modification of incorrect or incomplete data

·      Deletion of data when applicable

·      Management limitation

The requests must be directed to the Owner through official previously established means.

10. Data Transfer

The data will not be shared to third parties, unless:

·      When necessary to comply with legal obligations

·      When required by competent authorities

·      When there is expressed approval from the data subject

11. Policy Modifications

The Owner reserves the right to modify this Privacy Policy at any given moment. The modifications will take effect when published on the Application.

Furthermore, the owner reserves the right, on sole discretion, to change, modify, add or delete parts of the present Privacy Policy at any given moment. In which case, the modifications will be published on the Application and will indicate the date of the last version of the Policy. We recommend visiting the Application periodically with the purpose of staying informed on all changes. This Policy governs itself by the applicable laws regarding data protection and privacy in the United States of America, without prejudice of other normative that could result applicable.
